Janjivan Bureau / New Delhi : Allahabad HC acquitted father Rajesh Talwar and mother Nupur Talwar in Arushi Murder case. Its expected that Talwar couple will release from Dasna jail on Friday.The judges have overruled the judgment of the trial court. It has freed the Talwars, giving them the benefit of doubt in the case.
The Allahabad High Court has said that there was no chain of evidence and we can’t convict on the basis of mere suspicion.
The CBI counsel and the defence counsel are in attendance. Tafeeq Ahmad Mir, the lawyer for the Talwars is talking to the judge.
However, the Talwars parents filed a petition to High Court against the special CBI court sentence. In the wake of this petition on 7th September, the bench of Justice BK Narayan and Justice AK Mishra secured his decision on the appeal of the Talwars parents. And then the 12th October date for the decision was fixed by the Court.
It is the case of May 2008, when 14 years old Aarushi found dead in her house of Clifford Vihar area in Noida. And when Hemraj suspected for this crime then within two days his body was recovered from the roof of the house. Later the Chief Minister of the Uttar Pradesh Mayawati handed over this probe to the Special CBI court. Aarushi Murder case is one of the Hyped cases of India. Also, one of the Bollywood movie based on it titled Talvaar.
Aarushi was found murdered, with her throat slit, days before her 14th birthday, inside her bedroom in the flat no. L-32 in Jal Vayu Vihar, Noida, on May 16, 2008. Initially, it was suspected that Hemraj had killed Aarushi however, the case took a shocking turn when Hemraj’s body was recovered two days later from the terrace of the same flat. Notably, the door of the terrace was locked from inside.
The Uttar Pradesh Police suspected the Talwars of the double murder and said Rajesh Talwar had killed Aarushi and Hemraj after finding them in an ‘objectionable’ position. This enraged the Talwars, who accused the police of framing them to cover up a ‘botched’ investigation.
Following widespread outrage over the charges levelled on the dentist couple by the Uttar Pradesh, the case was handed over to Central Bureau of Investigation (CBI) which absolved the Rajesh and Nupur Talwar of all the charges. The team suspected Talwars’ assistant Krishna along with two domestic servants, Rajkumar Sharma and Vijay Mandal. Later in 2009, the case was handed over to a new CBI team which recommended closing the case owing to ‘critical’ gaps in investigation. The CBI however, rejected the closure report, on the objection of the couple, but ordered prosecution of the parents on the basis of existing evidence that lead to their eventual conviction.
